Important limits on the service we provide, and when you should speak to an advocate instead.

Please read this carefully. WillSetu is a document preparation and coordination service. We are not a law firm, and using this site does not create a solicitor-client or advocate-client relationship.

The content on willsetu.com — including our FAQs, guides and the questions in our will builder — is general information about Will-making in India. It is not legal advice and must not be relied on as advice for your particular circumstances. Laws change, and how they apply depends on facts we may not know about you.

2. We are not a law firm

[LEGAL ENTITY NAME] is not a law firm and does not practise law. Where a package includes review or consultation, that is provided by qualified professionals engaged for that purpose; it does not make us your legal representative. We cannot appear for you in court, obtain probate, or contest a Will.

3. Your document reflects your information

The Will we prepare is built from the information you give us. We do not independently verify your identity, your ownership of the assets you list, the accuracy of names and ages, or whether any asset is disputed or jointly held. Errors or omissions in what you tell us will be carried into the document.

4. A Will is only valid once properly executed

Indian law does not currently recognise a fully digital or electronically signed Will. A Will becomes legally valid only when it is printed, signed by hand by you (the testator), and attested by two witnesses who sign in your presence. Witnesses should not be beneficiaries or the spouse of a beneficiary — under Section 67 of the Indian Succession Act, 1925, a bequest to an attesting witness can be declared void.

Registration of a Will is optional under the Registration Act, 1908. A Will is valid without registration, though registration can make it harder to dispute.

5. When you should consult an advocate

We recommend independent legal advice if any of the following apply:

  • Your estate includes business interests, partnership stakes or shareholdings requiring succession planning
  • You hold assets outside India, or are subject to another country's succession or tax rules
  • Any asset is disputed, mortgaged, jointly held, or subject to litigation
  • You wish to create a trust, or to make provision for a dependant with a disability
  • Your family structure is complex — a blended family, an estranged spouse, or a likely challenge to the Will
  • Your estate is large enough that tax planning is a material consideration

6. Personal law applies

Succession in India is governed by personal law. Hindus, Buddhists, Sikhs and Jains are governed by the Hindu Succession Act, 1956; Christians and Parsis by the Indian Succession Act, 1925; and Muslims by their personal law, under which the freedom to bequeath is generally limited to one-third of the net estate without the consent of heirs. These rules affect what you can and cannot do in a Will.

7. No guaranteed outcome

We cannot and do not guarantee that a Will will never be challenged, or that a challenge will fail. A properly drafted, correctly executed and registered Will substantially reduces that risk; it does not eliminate it.

8. Third parties

Notaries, Sub-Registrar offices and payment processors are independent third parties. We coordinate with them but do not control their timelines, fees or decisions.
