1. Who we are
These Terms of Service govern your use of willsetu.com and any service you purchase from us. "WillSetu", "we", "us" and "our" refer to [LEGAL ENTITY NAME], operating from [FULL REGISTERED ADDRESS]. "You" refers to the person using the site or purchasing a package.
By using this site or buying a package, you agree to these Terms. If you do not agree, please do not use the service.
2. What we provide
WillSetu provides guided Will drafting, expert review, and coordination of notarisation or registration. Depending on the package you choose, this may include:
- A guided questionnaire or a consultation to capture your wishes
- Drafting of a Will structured around the Indian Succession Act, 1925
- Review of your draft by our team
- Coordination of notarisation, or registration at the Sub-Registrar Office
- Guidance on correct signing and witnessing
The specific inclusions of each package are listed on our pricing page and are what we are contractually obliged to deliver.
3. What we do not provide
We are not a law firm and we do not provide legal representation. We do not appear in court, contest a Will, obtain probate, or act as your executor. For estates involving disputed assets, business succession, foreign assets, trusts, or tax planning, we recommend you engage an independent advocate. See our disclaimer.
4. Your responsibilities
The document we prepare reflects the information you provide. You are responsible for:
- Giving accurate, complete and current information about yourself, your family and your assets
- Reviewing your draft carefully before it is finalised, including the spelling of every name
- Signing the Will by hand in the physical presence of two witnesses who are not beneficiaries
- Storing the signed original safely and telling your executor where it is
We are not liable for a Will that fails or is challenged because the information you supplied was inaccurate or incomplete, or because it was not executed correctly.
5. Fees and payment
Package prices are shown on our pricing page and are one-time charges in Indian Rupees. Prices include the services listed for that package. Payments are processed by Razorpay; we do not store your card details. Government fees, stamp duty (where applicable) and travel outside the covered city are not included unless expressly stated.
You will see a preview of your draft before payment is requested. Payment confirms your instruction to proceed.
6. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
7. Turnaround
We work to the timelines indicated for your package, but some steps depend on third parties — notary availability, Sub-Registrar appointment slots, and your own availability for consultation. Delays caused by government offices or by you are outside our control.
8. Intellectual property
The website, its design, text, and our clause library remain our property. The finished Will document prepared for you is yours to use for your own estate planning. You may not resell, redistribute or commercially exploit our templates or clause library.
9. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or in connection with the service is limited to the amount you paid us for the package in question. We are not liable for indirect or consequential losses, including loss of inheritance, delay in distribution of an estate, or disputes among beneficiaries.
Nothing in these Terms limits liability for fraud or for anything that cannot lawfully be limited.
10. Privacy
Your information is handled in accordance with our Privacy Policy.
11. Changes to these Terms
We may update these Terms. The version published on this page at the time of your purchase governs that purchase. Material changes will be reflected in the "last updated" date above.
12. Governing law and jurisdiction
